Reference: Tariff Notices 99 and 99A

Forbearance

1.

The Commission received an application by O.N.Telcom, dated 7 November 2002 and amended on 26 November 2002, to revise General Tariff items 2340, 2341 and 2350 to 2355, Private Branch Exchange Service, and item 2500, Miscellaneous Equipment, in order to request forbearance on competitively provided terminal equipment, pursuant to Regulatory framework - Ontario Northland Transportation Commission, Telecom Decision CRTC 98-14, 1 September 1998 (Decision 98-14).

In Decision 98-14, the Commission directed O.N.Telcom to file tariffs deleting the reference to the sale, lease or maintenance of terminal equipment should the company desire forbearance on terminal equipment in accordance with section 34 of the Telecommunications Act.

The Commission notes that the scope of forbearance that was granted in Decision 98-14 did not include items 2340 and 2341 pertaining to Private Branch Exchange - Direct Inward Dialing.

In light of the above, the Commission approves O.N.Telcom's request to delete reference to the sale, lease or maintenance of terminal equipment in items 2350 to 2355 and item 2500 of its General Tariff. The revisions take effect as of the date of this order. Further, the Commission denies O.N.Telcom's application for forbearance regarding items 2340 and 2341, Private Branch Exchange - Direct Inward Dialing.

O.N.Telcom is to issue revised tariff pages forthwith to reflect these changes.
