  At the 20 October 2003 public hearing, the Commission will examine applications to renew the licences of two direct-to-home (DTH) broadcasting distribution licensees three and Multi-point Distribution System (MDS) licensees. These applications are items 1 and 2 in Part A and items 3 to 5 in Part B of the Notice of Public Hearing.
  PREAMBLE
  PART A
  DTH licence renewals
  The licensing framework for direct-to-home (DTH) broadcasting distribution undertakings (BDUs) was set out by the Commission in Introductory statement - Licensing of new direct-to-home (DTH) satellite distribution undertakings, and new DTH pay-per-view (PPV) television programming undertakings, Public Notice CRTC 1995-217, 20 December 1995 (Public Notice 1995-217). In New, national, direct-to-home satellite distribution undertaking, Decision CRTC 95-901, 20 December 1995 (Decision 95-901), and New, national, direct-to-home satellite distribution undertaking, Decision CRTC 96-529, 27 August 1996 (Decision 96-529), the Commission approved applications by ExpressVu Inc., the predecessor to Bell ExpressVu Limited Partnership, and by Star Choice Television Network Incorporated, respectively, for licences to carry on DTH BDUs.
  In its Report on French-language broadcasting services in a minority environment, Public Notice CRTC 2001-25, 12 February 2001 (Public Notice 2001-25), the Commission stated that it expects satellite service providers to offer regional signals of the CBC in both official languages. In this renewal process, the Commission intends to examine, among other things, the licensees' distribution of such signals.

Application No. 2001-1313-4 (e)
  Application by STAR CHOICE TELEVISION NETWORK INCORPORATED (Star Choice) to renew the broadcasting licence of its national direct-to-home distribution undertaking expiring 29 February 2004.
  In its application, Star Choice submitted, among other things, that several of its original conditions of licence are no longer necessary in light of the enactment of the Broadcasting Distribution Regulations (the Regulations), which include provisions relating to DTH distribution undertakings. Star Choice has also requested amendments to those original conditions of licence that it suggested be retained, in many cases, to amend them in a manner that it submitted is consistent with the enactment of the Regulations.
  Star Choice also requested that other conditions approved by the Commission since its initial licensing decision remain in effect, including conditions related to the use of local availabilities and service to multiple unit dwellings.
  Star Choice stated in its application that the launch and commercial deployment of Anik F2 will not take place before mid-2004. Star Choice submitted that, as a result, it currently has no available capacity to launch new, small market, independently owned television stations as contemplated in Licence amendment for Star Choice - relief from requirements for simultaneous and non-simultaneous program deletion, Broadcasting Decision CRTC 2003-258, dated 16 July 2003, and Direct-to-home (DTH) broadcasting distribution undertakings - simultaneous and non-simultaneous program deletion and the carriage of local television signals in smaller markets, Broadcasting Public Notice CRTC 2003-37, dated 16 July 2003. Accordingly, Star Choice requested an amendment to section 1(b) of the Schedule to Decision CRTC 2003-258 that would permit a delay in the launch of these services.
  Star Choice submitted that, in light of Decision CRTC 2003-258 and Public Notice CRTC 2003-27, the maximum proportion of its 5% revenue contribution that it is permitted to contribute directly to Canadian broadcasting undertakings must be revised downward, from 20% of its total contribution to 12% of that contribution. Star Choice proposed a licence amendment to that end. The Commission notes that section 44 of the Regulations does not provide for exception by condition of licence. In light of this, the Commission may wish to discuss this aspect of the application at the public hearing.

  Application by BELL EXPRESSVU INC., the General Partner, and BCE INC. and 4119649 CANADA INC. (Partners in BCE HOLDINGS G.P.), the limited partners, carrying on business as BELL EXPRESSVU LIMITED PARTNERSHIP (ExpressVu) to renew the broadcasting licence of its national direct-to-home undertaking expiring 29 February 2004.
  In its application, ExpressVu stated, among other things, that most of its original conditions of licence are no longer relevant, as they were superseded by the enactment of the Broadcasting Distribution Regulations (the Regulations). ExpressVu also requested amendments to other conditions of licence, in many cases, to amend those conditions in a manner that it submitted is consistent with the enactment of the Regulations.
  ExpressVu also requested a licence amendment to permit it to engage in the practice of bulk billing in multiple unit dwellings on the same basis as cable distribution undertakings.
  In its application of 19 November 2001, ExpressVu stated that the Commission may wish to clarify that the reference in section 39(a) of the Regulations to "all licensed programming undertakings" includes both licensed television and radio undertakings. In a letter dated 12 August 2003, ExpressVu noted that section 23 of the Regulations grants Class 1 and 2 cable operators authority to distribute audio services. ExpressVu stated that there is no similar clause in the DTH section of the Regulations. Accordingly, ExpressVu requested that it be granted a condition of licence similar to section 23 of the Regulations.

  PART B
  MDS licence renewals
  At the hearing, the Commission intends to consider the following issues, among others, with respect to the overall regulatory framework applicable to MDS licensees and invites interested parties to comment on any of these issues.
  Moratorium on the assignment of MDS spectrum
  The Commission notes that, by letter dated 20 June 2003, the Department of Industry (the Department) informed the Commission that it has issued a moratorium on the assignment of MDS spectrum in regions of Canada in which MDS broadcasting licences have not been issued. This moratorium will remain in effect until the completion of a public consultation process, which is expected to take 18 to 24 months. The Department has indicated that this moratorium will not affect existing MDS broadcasting licensees and their authorized service areas or the ability of the Commission to renew or modify these licences.
  Competition with other BDUs
  In its report to the Governor-in-Council entitled Competition and Culture on Canada's Information Highway, 19 May 1995, the Commission stated that there was no longer any need to limit competition between cable and other broadcasting distribution undertakings. Since that time, MDS undertakings have been licensed as full competitors to other broadcasting distribution undertakings. The Commission will consider whether and, in what way, the role of MDS undertakings in the broadcasting distribution market has changed and what, if any, alterations should be made to the regulatory framework applicable to these undertakings to reflect these changes.
  Carriage of programming services in the official language of the minority
  In Achieving a better balance: Report on French-language broadcasting services in a minority environment, Public Notice CRTC 2001-25, 12 February 2001, the Commission, recognizing the limited transmission capacity of MDS licensees, chose not to impose any specific obligations on these licensees with respect to the distribution of speciality services in the minority official language. Instead, the Commission proposed to deal with issues related to the number of specialty services distributed in the minority official language at the time of MDS licensing and renewal. Accordingly, the Commission will examine these issues in this proceeding.

  Application by CRAIG WIRELESS INTERNATIONAL INC. to renew the licence of its radiocommunication distribution undertaking multipoint distribution system (MDS), serving Brandon, expiring 29 February 2004.
  Craig Wireless International Inc. also submitted request for amendments or deletion of Conditions of Licence (COL):
 

1) request to change references to the Broadcast Distribution Regulations (COL No. 1);

 

2) request to remove the requirement to carry the community channel and educational channel. The applicant also requests authorization to offer any licensed television or radio programming service and to be authorized to carry all of the programming services set out in the List of Part 2 Eligible Satellite Services, and the list of Part 2, Part 3 and DTH Eligible Satellite Services for Digital Distribution (COL No. 2 to No. 5);

 

3) request that the current carriage and linkage requirement be deleted. Applicant is of the view that Section 6 of the Broadcast Distribution Regulations is adequate (COL No. 6 to No. 8);

 

4) request that there be a reduction in the contribution to Canadian programming from 6% to 5%, and that it be payable over the course of its licence term (COL No. 10).

  Application by LOOK COMMUNICATIONS INC. (Look) to renew the licences of its multipoint distribution system (MDS) undertakings, serving the above-mentioned locations, expiring 29 February 2004.
  Look is also proposing that the terms and conditions of its Quebec licence be identical to that of its Ontario licence, subject only to the specific identity of any listed services. Look states that the current licensing framework under the Ontario licence provides for greater flexibility.
  In addition, Look is requesting that it be granted flexibility to use alternative technologies and increased flexibility in the packaging of its services. Moreover, Look is proposing the following amendments to the terms and conditions of its Ontario licence:
 

1) request to change references to the Cable Television Regulations, 1986. Look proposes that its licence conditions be updated to make reference to the equivalent sections of the Broadcasting Distribution Regulations that have since been enacted;

 

2) request that it be authorized to carry any additional Canadian programming services that it would otherwise be required to carry pursuant to Section 17 of the Broadcasting Distribution Regulations;

 

3) request to amend condition of licence No. 5 regarding distribution and linkage requirements;

 

4) request to amend condition of licence No. 7 which requires Look to contribute 5% of its gross annual revenues to support the development of Canadian programming. Look is seeking relief from the requirement of Section 29 of the Broadcasting Distribution Regulations until its gross annual revenues derived from broadcasting activities equals or exceeds $25,000,000 and;

 

5) request to be relieved of the requirement to maintain an independent programming committee and to repeal BY-LAW No.2, as required by the Commission in Decision CRTC 99-152.

  The applicant proposes an Adult Contemporary music format.
  The applicant is requesting permission to simulcast the programming of CIYR on the AM band for a period of three months from the date of implementation of the new FM station.
  The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.
  This application requires the issuance of a new licence.
