Extension of local management agreement

Newcap Inc. (Newcap) is the licensee of CHTN Charlottetown. Maritime Broadcasting System Limited (Maritime Broadcasting) is the licensee of Charlottetown's two other radio stations, CFCY and CHLQ-FM. The three stations have operated under the terms of a local management agreement (LMA) between the two licensees since 1994. In 2002, the Commission authorized the continued operation of these stations under the LMA by conditions of licence, pursuant to section 11.1(1) of the Radio Regulations, 1986 (see Local management agreement - Charlottetown, Broadcasting Decision CRTC 2002-181, 8 July 2002 (Decision 2002-181). The authority granted by the conditions of licence was for a period set to terminate on 31 August 2003.

In Broadcasting Public Notice CRTC 2003-27, 15 May 2003, the Commission announced its receipt of applications by Newcap and Maritime Broadcasting for licence amendments that would extend the authority contained in their conditions of licence, thereby permitting them to continue to operate the stations under the terms of the LMA until 31 August 2004, the date on which the three licences expire. There was no intervention filed with respect to these applications.

The Commission's LMA policy was announced in Local Management Agreements, Public Notice CRTC 1999-176, 1 November 1999 (Public Notice 1999-176). Public Notice 1999-176 sets out the circumstances in which the Commission would generally be inclined to approve LMAs, although it stated that the evaluation of their appropriateness would be conducted on a case-by-case basis.

Given the upcoming renewal of these licences, the Commission approves the licensees' applications for licence amendments, and extends the authority granted Newcap and Maritime Broadcasting to operate CHTN, CFCY and CHLQ-FM Charlottetown under the terms of the current LMA until 31 August 2004. The Commission will conduct a public process to consider applications for the renewal of these licences well in advance of their expiry on 31 August 2004. As part of the renewal process, the Commission will examine fully the issues surrounding the LMA and its terms in light of Public Notice 1999-176.
