Application by CTV TELEVISION INC. to renew the licence of television station CFCF-TV, Montreal expiring 31 August 2002.

 

Decision CRTC 97-484 dated 22 August 1997 approved a transfer of control of CFCF-TV from Le Groupe Vidéotron ltée and CF-12 inc. to 3321118 Canada Inc. (WIC Television Ltd. 70% and Capital Communications CDPQ Inc. 30%). Tangible benefits included a $4 million fund for the acquisition of English language programs in underrepresented programming categories from Quebec independent producers over a five-year period. The purchaser also committed to expend $3 million to purchase and equip a fully digital mobile production truck.

 

Decision CRTC 2001-604 dated 21 September 2001 approved CTV's acquisition of the shares of CF Television Inc. from a trustee temporarily managing the licensee on behalf of Global Communications Limited (70%) and Capital Communications CDPQ Inc. (30%). One of the benefits of that transaction was the establishment of a Montreal program development office to dispense funds over a five-year period to Quebec independent producers for script and concept development.

 

The Commission has a longstanding policy requiring purchasers to assume the responsibility of fulfilling any benefit commitments that the previous licensees had not fulfilled. Correspondence on the file indicates that CTV has encountered difficulties confirming the extent to which the previous owners had fulfilled the 1997 benefits. For several reasons CTV is unwilling to assume responsibility for discharging these benefits.

In order to conform to paragraph 7 of Decision CRTC 2001-746 dated 7 December 2001, the licensee proposes to add the following conditions of licence:

 
· the applicant shall allocate $6,798,000 (i.e., 92% of the proposed tangible benefit package) to Canadian independent producers, excluding undertakings directly or indirectly linked to shareholders of the licensee, for the production of new priority programs from categories 7b) and 9 for original broadcast on the TQS network.
 
· The applicant is also proposing to include priority programming in Category 7f) (Programs of comedy sketches, improvisations, unscripted works, stand-up comedy), programs in Category 8a) (Music and Dance) and regionally produced programs in Category 11 (General entertainment and human interest), as benefits under the afore mentioned conditions.
 
· the applicant shall file an audited annual report to be used to verify the implementation of the tangible benefits. These detailed annual reports must be consistent with the format proposed by the applicant and accepted by the Commission, as set out in the appendix to Decision CRTC 2001-746.
