People's Telephone Company of Forest Inc.

Call management features and custom calling features

1.

The Commission received an application by People's Telephone Company of Forest Inc. (People's), dated 17 July 2002, to revise General Tariff section 490, Miscellaneous Equipment, in order to:

a) increase the monthly rates for residential call management and custom calling features as follows:
- Call Forwarding, Call Forward No Answer, Call Forward Remote Access, Call Forward Busy and Speed Dial 8 from $1.00 to $3.00;
- Three-Way Calling from $2.00 to $3.00;
- Speed Dial 30 and Call Waiting from $2.00 to $4.00;
- Call Return, Call Screen, and Ident-A-Call from $3.00 to $5.00;
- Call Display from $5.00 to $6.00; and
- Visual Call Waiting from $11.50 to $14.00;
b) increase the monthly rates for business call management and custom calling features as follows:
- Speed Dial 8 from $1.00 to $4.50;
- Speed Dial 30 from $2.00 to $5.50;
- Call Waiting from $3.00 to $5.50;
- Call Forwarding, Call Forward No Answer, Call Forward Busy, Call Forward Remote Access, and Three-Way Calling from $2.00 to $4.50;
- Call Return, Call Screen and Ident-A-Call from $5.00 to $7.00;
- Call Display from $7.00 to $8.00; and
- Visual Call Waiting from $14.00 to $18.00;
c) introduce optional service bundles at the following monthly rates:
- Call Display Pack, consisting of Call Display, Call Name Display, Call Forwarding, Three-Way Calling and Call Return, at $14.95;
- Call Messaging Pack consisting of Call Answer, Call Name Display, Call Display and Call Waiting, at $14.95;
- In-Touch Pack, consisting of Call Answer with E-mail option, Call Forwarding and Three-Way Calling, at $11.95; and
- Business Pack consisting of Call Name Display, Call Display, Call Forwarding and Call Answer with Additional Capacity and Personal Operator, at $19.95;
d) introduce a promotion whereby customers who subscribe during the months of June or November to three of the custom calling or call management features will not be billed for the first 30 days of service.

The Commission received no comments with respect to the application.

The Commission notes that, in Regulatory framework for the small incumbent telephone companies, Decision CRTC 2001-756, 14 December 2001, it assigned the services in question to the fourth price cap service basket. In that decision, the Commission determined that rates for services in the fourth basket would generally be permitted to increase up to any already approved rate for the same service. The Commission further stated that tariff applications should reference when and where the Commission had already approved the rate for the same service. The Commission also determined that an economic study would be required if any proposed rate increases were greater than an already approved rate.

The Commission finds that the proposed rates for all services except for People's Call Forward No Answer Business, Call Forward Busy Business and Call Forward Remote Access Business services, were previously approved by the Commission for the same services provided by other companies.

The Commission notes that People's did not provide any references to previous Commission decisions to confirm whether the proposed rates for its Call Forward No Answer Business, Call Forward Busy Business and Call Forward Remote Access Business services, were previously approved by the Commission. The Commission also notes that People's did not provide any economic studies in its application, to support the proposed rates for these services. The Commission notes that it has previously approved a rate of $4.00 for the same services.

In light of the above, the Commission approves the rate increases proposed by People's, except for Call Forward No Answer Business, Call Forward Busy Business and Call Forward Remote Access Business, for which a rate of $4.00 is approved. The revisions take effect as of the date of this order.

People's is to issue revised tariff pages forthwith to reflect these changes.
