Label Service

The Commission received an application by MTS Communications Inc. (MTS), dated 8 March 2002, to revise its General Tariff item 2126, Label Service. Label Service is a customer-requested operating arrangement through which all incoming calls to a specific number are intercepted and the calling parties referred to another telephone number.

In its application, MTS proposed to remove the requirement that the referral number be another telephone number listed under the same customer's name and to remove the service charge where the referral number is to a new telephone number of a wireline or wireless service provided by MTS.

In addition, MTS proposed to eliminate the grace period during which residential customers are exempt from charges for up to three months and business customers are exempt from charges until the publication of the new directory. MTS stated that it had been its practice to provide a grace period to customers, although this is not reflected in its tariff.

The Commission received no comments with respect to the application.

The Commission notes that under MTS' proposal, only those customers obtaining new numbers from a competitor would pay the service charge associated with Label Service. The Commission finds that this application of service charges would be anti-competitive.

The Commission approves MTS' application, with the exception of the proposal to remove the service charge where the referral number is to a service provided by MTS.
