Call for comments on proposals by sponsors for the addition of non-Canadian satellite services to a digital list of eligible satellite services

  In Public Notice CRTC 2000-173 dated 14 December 2000, the Commission issued a call for proposals by Canadian sponsors for the addition to the lists of eligible satellite services of non-Canadian services that would be available for distribution on a digital basis only. In the present notice, the Commission now invites public comment on the specific services that have been proposed.
 

Background

1. In response to PN 2000-173, the Commission received submissions from nine separate Canadian sponsors requesting the addition to the lists of some 30 non-Canadian satellite services. An appendix to this notice contains a brief description of each of the services, as taken from the submissions themselves, and the names and addresses of the Canadian sponsors.
2. As stated in PN 2000-173, the Commission intends to assess these requests against the background of its general policy. This policy, among other things, precludes the addition of new non-Canadian satellite services that can be considered either totally or partially competitive with Canadian specialty or pay television services.
3. In applying this policy, the Commission will take into account the services of all specialty and pay television programming undertakings whose licence applications have, to date, been approved by the Commission. These include all of the Category 1 and Category 2 specialty programming services approved in Decisions CRTC 2000-449 to 2000-731.
4. As indicated in PN 2000-173, the Commission intends to place any additional non-Canadian services on a separate list, within the larger group that makes up the existing lists of eligible satellite services. Services on the new list will be eligible for distribution, on a digital basis only, by all distributors, including licensees of cable distribution undertakings and multipoint distribution systems, as well as those of direct-to-home satellite distribution undertakings.
5. All of the sponsored requests are for television services with one exception, that being a request for the addition of a radio service. Certain of the sponsored requests are for the addition of non-Canadian satellite services that provide religious programming. As indicated in the Commission's Religious Broadcasting Policy (Public Notice CRTC 1993-78), any such services that are placed on the new list following this public process may only be linked, or "packaged", with Canadian single or limited point-of-view discretionary religious services. Some of the sponsored requests involve services that feature predominantly adult programming. For these, the Commission intends to apply the same distribution requirements as those that it has applied to the non-Canadian satellite service known as Playboy TV. These requirements are set out in Public Notice CRTC 2000-143 dated 28 October 2000.
 

Call for comments

6. Interested parties wishing to file comments on any of the sponsored non-Canadian services listed in the appendix are invited to do so. They should also submit a true copy of their comments to the appropriate Canadian sponsor, or sponsors if there is more than one for a given service, at the addresses provided in the appendix. Proof that comments have been sent to sponsors must accompany the original of the comments sent to the Commission.
7. Comments must be received by the CRTC and by the Canadian sponsors on or before 2 April 2001.
8. Parties should clearly identify the request or requests to which their comments apply. They should also indicate whether they support, oppose, or propose changes to the requests, and should include the facts and grounds therefor.
9. Those identified in the appendix as sponsors of requests filed pursuant to PN 2000-173 may file a written reply to any comments received concerning their requests. Such replies should be filed with the Commission, and a copy sent to the person who submitted the comments by no later than 2 May 2001.
10. The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed.
 

Procedures for filing comments

11. Interested parties can file their comments with the Commission on paper or electronically. Submissions longer than five pages should include a summary.
12. Parties wishing to file their comments on paper should send them to the Secretary General, CRTC, Ottawa, K1A 0N2.
13. Parties wishing to file electronic versions of their comments can do so by email or on diskette. The Commission's email address is procedure@crtc.gc.ca 
14. Electronic submissions should be in the HTML format. As an alternative, those making submissions may use "Microsoft Word" for text and "Microsoft Excel" for spreadsheets.
15. Please number each paragraph of your submission. In addition, please enter the line ***End of document*** following the last paragraph. This will help the Commission verify that the document has not been damaged during transmission.
16. The Commission will make comments filed in electronic form available on its web site at www.crtc.gc.ca  in the official language and format in which they are submitted. This will make it easier for members of the public to consult the documents.
17. The Commission also encourages interested parties to monitor the public examination file (and/or the Commission's web site) for additional information that they may find useful when preparing their comments.
