Conversion of CHRL from AM to FM

The Commission approves the application for a French-language FM radio station at Roberval to replace AM station CHRL. The terms and conditions of licence are set out in the appendix to this decision.

The proposed service

The new station will offer CHRL's current programming, namely spoken word programming and popular and "oldies" music format. Currently, 60% of the programming broadcast by CHRL is local, with the remainder originating from the Radiomédia network.

The Commission stated in Public Notice CRTC 1993-121 that to be considered a single-station market, the 3mV/m contour of an FM station should not encompass a significant part of a second community that another AM or FM commercial radio station has been licensed to serve. In its application, the applicant indicated that the 3m/Vm contour of the new FM station includes the city of Alma, which is already served by CFGT and CKYK-FM, both owned by Groupe Radio Antenne « 6 » inc. (the Groupe), the owner of CHRL. Given that the conversion of CHRL from AM to FM does not affect its service to the community or any other services in the area, and that all the stations in the region are owned by the Groupe, the Commission approves the applicant's request that the new FM station's market be considered a single-station market. Consequently, the licensee is exempted from the requirement that, in order to solicit or accept local advertising, one-third of its programming must be local.

The applicant has requested authority to broadcast simultaneously on the AM and FM bands for a period of three months. A condition of licence to this effect is set out in the appendix to this decision. At the end of this period, the Commission expects the licensee to surrender the AM licence for revocation by the Commission.

The Commission acknowledges the intervention submitted by l'Association québécoise de l'industrie du disque, du spectacle et de la vidéo (ADISQ) and is satisfied with the licensee's reply.

Appendix to Decision CRTC 2001-548

 

Terms of the licence for the FM radio programming undertaking at Roberval

 

A licence will be issued and effective when the licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.

 

The station will broadcast on the FM band, on the frequency 99.5 MHz, channel 258B. The Department of Industry has advised that the undertaking will have an average effective radiated power of 16,600 watts rather than 50,000 watts, as indicated in Notice of Public Hearing CRTC 2001-6 dated 18 May 2001.

 

The Department of Industry has advised the Commission that this application is conditionally technically acceptable, subject to determination that there is no unacceptable interference with NAV/COM services. When the Department certifies that a broadcasting certificate will be issued, the Commission will issue the licence and the licensee may begin operation (section 22(1) of the Broadcasting Act).

 

The licence, when issued, will expire on 31 August 2008.

 

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources (PN 1992-59).

 

Conditions of licence

 

The licence will be subject to the conditions specified in the licence to be issued, as also set out in Public Notice CRTC 1999-137. The licence will also be subject to the following condition:

 

· the licensee is authorized to simulcast the programming of CHRL on the new FM station for a transition period of three months following implementation.
