New cable distribution undertaking

1.

The Commission approves the application by South Cariboo Communications Inc. for a licence to carry on a cable distribution undertaking to serve Lillooet and will issue, subject to the requirements of this decision, a Class 3 licence expiring 31 August 2007.

2.

The operation of this undertaking will be regulated pursuant to the Broadcasting Distribution Regulations (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

3.

The licensee may receive any authorized signal over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings.

4.

The licensee is relieved, by condition of licence, from the requirement of section 32(1) of the regulations to distribute the local signals of CHWS-TV-1 and CILY-TV-1 which rebroadcast the programming services of CFJC-TV (CBC) and CHKM-TV (CTV) Kamloops.

5.

Although the Commission does not regulate the rates of Class 3 undertakings, it notes that the applicant has proposed a monthly subscriber fee of $25.

6.

It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary code regarding violence in television programming, as amended from time to time and approved by the Commission.

7.

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources (PN 1992-59).

8.

The Commission will only issue the licence, and it will only be effective at such time as the licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.
