Riptide Networks Inc.'s proposed General Tariff
Tariff Notice 1
The Commission approves on an interim basis, with the changes listed below, Riptide Networks Inc.'s proposed General Tariff covering general terms and conditions and access services.

Riptide Networks Inc. filed an application for approval of its General Tariff (CRTC Tariff 21390), covering general terms and conditions and access services for interconnection with local exchange carriers (LECs), interexchange service providers (IXSPs) and wireless service providers (WSPs).

Bell Canada filed comments on 2 June 2000 on behalf of itself and on behalf of Island Telecom Inc., Maritime Tel & Tel Limited, MTS Communications Inc., NBTel Inc. and NewTel Communications Inc.

Bell Canada submitted that the definitions for the following terms require amendments: "class B licensee", "feature group D service", "line-side access", "Canada-U.S. circuit", "overseas circuit", "telephone numbers", "trunk-side access", "CCS7 signalling interconnection", and "wireless service provider". Bell Canada also submitted that Riptide's tariff requires a definition for the term "competitive pay telephone service provider" and that the definitions for "company loop transmission" and "link" should be deleted since Riptide is not offering loops or co-location to other carriers.

Bell Canada noted that some of the contribution provisions in Riptide's tariff require amendments to correctly reflect the determinations in the Commission's decisions issued late in 1999 with respect to contribution.

Bell Canada also submitted that in Riptide's terms and conditions associated with the provision of access service to WSPs, the words "subject to availability" should be removed to be consistent with the Commission's determinations with respect to other competitive local exchange carriers' (CLEC) tariffs.

On 5 June 2000, Riptide responded to Bell Canada's comments stating that, at the Commission's direction, Riptide will re-issue its proposed pages to incorporate changes suggested by Bell Canada.

The Commission notes that the term "link" appears in the tariff and considers that a definition for the term is appropriate. The Commission also considers that, except for minor corrections, Riptide's contribution and contribution exemption provisions are consistent with other LECs' tariffs.

The Commission finds that all other changes suggested by Bell Canada are appropriate and should be implemented by Riptide.

On 12 May 2000, the Commission issued Final rates for call routing - Local routing number absent service, Order CRTC 2000-394. Riptide's call routing - local routing number absent tariff provisions require amendments to reflect the revised rates approved for the service in the order.

On the same date, the Commission issued Providing trunk-side access and common channel signalling #7 to wireless service providers, Order CRTC 2000-395. Riptide's tariff also require amendments to its access services tariff for interconnection with WSPs to reflect the Commission's determination in that order.

The Commission also considers that Riptide's tariff requires a number of other minor changes for the purpose of correcting and/or clarifying various references and provisions.

In light of the foregoing, the Commission orders that:

1. The proposed tariffs are approved on an interim basis, with the following changes:
A) In Item 101, Terms of Service:
a) in sub-item 6.7, delete the words "including anticipated long distance charges" from the end of the sentence;
b) in sub-item 8.3, change the reference from "Article 10" to read "Article 10.1"; and
c) in sub-item 10.1, delete the words "the greater of $20.00 and".
B) In Item 102, Definitions:
a) in the definition for "account receivable" replace the term "IXC" with the term "IXSP";
b) in the definition for "Canada-U.S. circuit" delete the phrase "where the Class A Licensee controls the routing of the traffic carried on the circuit";
c) in the definition for "class B licensee", replace item b) with the following: "operates telecommunications equipment that converts basic international traffic from circuit-switched minutes originating in Canada to non-circuit-switched traffic, or from non-circuit-switched traffic to circuit-switched minutes terminating in Canada.";
d) delete the definition of "company loop transmission (COLT)";
e) add the following definition of "competitive pay telephone service provider" "means a company or individual which provides competitive pay telephone service for use by the general public. For the purpose of this tariff, the competitive pay telephone service provider is the Company's customer.";
f) in the definition for "Feature Group D service" replace the second occurrence of "011+" with "01+";
g) in the definition for "line-side access" add the words "or egress" immediately after the words "to access";
h) replace the definition of "overseas circuit" with the following: "means a circuit that connects a service or a facility of an international service provider to a country other than the United States, directly or via an overseas carrier, for the purpose of providing overseas services.";
i) in the definition of "telephone numbers" add the phrase "with outpulsing" immediately after the word "numbers"; and
j) in the definition of "trunk-side access" add the dialing provision "1+950".
C) In Item 301(o), replace the term "ILEC's" with the term "ILEC".
D) In Item 301(p), replace the "IXSP" with the term "IXC".
E) In Item 302(1)(b), add the dialing provision "1+950".
F) In the first sentence of Item 302(1)(e), replace the word "wit" with the word "with".
G) In the first sentence of Item 302(3)(a), replace the word "subscriber" with the word "subscribed".
H) In the tables in Items 305(1) and 305(2)(a), insert the word "ILECs," immediately before the words "Carriers and other service providers that have attested that they do not use DALs".
I) In "Note 1" of Item 305(2)(a), add the words "or other service provider" immediately after the words "attesting to the fact that the carrier".
J) In Item 305.2(b):
a) in sub-item (i), replace "Canada-U>S>"with "Canada-U.S.";
b) in sub-item (ii), add the words "is located" immediately prior to the words "all contribution-eligible minutes"; and
c) in sub-item (iii), remove the first occurrence of the words "to the ILEC" which immediately follows the "(a)".
K) In Item 400:
a) delete the term "ISUP" from the definition of "CCS7 signalling interconnection";
b) delete the definition of "telephone numbers"; and
c) add the following to the end of the definition for "wireless service provider": "service in areas served by Riptide".
L) In Item 401(a), delete the words "however, this arrangement is only available in areas where the Company operates as a CLEC and is subject to availability" from the end of the second sentence of the provision.
M) In Item 402(1), add the words "associated with line-side interconnection" immediately after the word "outpulsing".
N) In Item 403.3(b):
a) amend the first row of the table to read "Line-side access";
b) amend the rates in the column entitled "Ontario/Quebec" as follows:

T) Delete the phrase "under the terms of this tariff" from the first sentence in Item 602(.1).
2. Riptide is to issue forthwith revised tariff pages incorporating the changes set out above.
3. Riptide is directed to file forthwith its PIC/CARE (primary interexchange carrier/customer account record exchange) Handbook and an unexecuted copy of its Basic listing interchange file (BLIF) agreement for approval.
