Canadian Alliance of Publicly-Owned Telecommunications Systems final 1999 Carrier Access Tariffs

The Commission approves final 1999 Carrier Access Tariff (CAT) rates for the period 1 January 1999 to 31 December 1999.
The Commission directs the Canadian Alliance of Publicly-Owned Telecommunications Systems to provide actual 1999 rates of return by 31 October 2000 and file proposed final 2000 CATs within 45 days.

On 30 November 1999, pursuant to Telecom Order CRTC 99-941, dated 30 September 1999, Canadian Alliance of Publicly-Owned Telecommunications Systems (CAPTS) filed, on behalf of its members, under Tariff Notice (TN) 08, proposed final 1999 Carrier Access Tariffs (CATs) that ranged between $0.0317 and $0.0560 per minute.

On 20 December 1999, Bell Canada raised issues with respect to both the calculations and the level of rate increases included in the CAPTS's proposed final 1999 contribution requirements.

On 12 April 2000, CAPTS filed revised proposed final 1999 CATs, under Tariff Notice 8A, that ranged between $0.0268 and $0.0519 per minute. The revisions related to CAPTS's contribution requirements.

1999 Contribution-eligible minutes

CAPTS's 1999 contribution and direct toll proxy minutes increased on average 28.8% and 29.6%, respectively, over 1998. The Commission considers these increases to be significant.

However, the Commission notes that for 1999, the contribution and direct toll components are settled based on proxy minutes rather than actual minutes resulting in the amount of contribution received being equal to the amount approved. Consequently, the significant increase in number of contribution-eligible minutes has no impact on the final contribution requirement.

The Commission accepts CAPTS's proposed 1999 contribution and direct toll proxy minutes to be used in the calculation of the contribution and direct toll rates.

CAPTS calculated its members' contribution requirements as the lower of a) the previous year's contribution requirement, after accounting for local rate increases, and b) the current year's (forecast Phase III) contribution requirement.

The Commission considers CAPTS's proposed 1999 contribution requirements to be reasonable.

1999 Direct toll components and rates

CAPTS proposed direct toll components based on the current year's forecast Toll Broad Service Category and provided an explanation for one member whose 1999 direct toll component exceeded the 1998 direct toll component by more than 5%.

The Commission considers CAPTS's proposed 1999 direct toll components and the explanation provided by Bruce Municipal Telephone System to be reasonable.

Implementation

In light of the above, the Commission:
a) approves CAPTS's Tariff Notices 08 and 8A for the final 1999 company-specific contribution and direct toll rates as listed in Appendix A of this order, for the period 1 January 1999 to 31 December 1999;
b) directs CAPTS to issue revised CAT tariff pages within 15 days;
c) directs CAPTS to provide actual 1999 rates of return for the regulated portion of its member companies when it files actual 1999 Phase III results, by 31 October 2000, and in the event that a company has over-earned, the amount that will be refunded to the toll provider(s); and
d) directs CAPTS to file proposed final 2000 CATs and all required supporting calculations and information within 45 days of this order.
