New Type B native radio programming undertaking

1.

The Commission approves the application for a broadcasting licence for an English-and Native-language native FM radio programming undertaking at Christian Island.

Consistent with Public Notice CRTC 1990-89 dated 20 September 1990 and entitled Native Broadcasting Policy, and subject to the requirements of this decision, the Commission will issue a licence for a Type B FM native radio undertaking, expiring 31 August 2006.

The new station will broadcast 56 hours each week of local programming of which approximately 2.5% will be in the Ojibway language. It will cover community events in Christian Island and offer news from a native perspective. According to the applicant, the station will foster understanding of native culture and traditions for both native and non-native communities in its coverage area.

To promote the development of Canadian talent, the applicant plans to interview local Aboriginal musicians and broadcast their demo tapes. In addition, the applicant will feature interviews and music by other Aboriginal artists from across Canada. It will also offer spoken word programming, including storytelling and poetry created by members of the Beausoleil First Nation community and other Aboriginal communities. The applicant stated that the station will be a training ground for young native broadcasters.

The Commission reminds the applicant that it is subject to all of the requirements set out in the Radio Regulations, 1986.
Conditions of licence

This licence will be subject to the conditions specified in this decision and in the licence to be issued. By condition of licence, the licensee must:
· broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, in accordance with the native radio policy for Type B stations;
· adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission; and
· adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
Other matters

The licence will only be issued and effective when:
· the Commission receives documentation establishing that an eligible Canadian corporation has been incorporated in accordance with the application in all material respects and that this corporation may be issued a licence; and
· the new station is ready to begin operation. When the licensee has completed construction and is prepared to commence operation, it must advise the Commission in writing. If the station is not constructed and ready to operate within 12 months of today’s date, extensions to this time frame may be granted provided that the licensee applies in writing to the Commission before the 12-month period or any extension of that period expires.

The new FM station will operate on the frequency 101.3 MHz, channel 267A, with an effective radiated power of 900 watts. The Commission notes that the application, as originally filed, was predicated on the use of frequency 94.7 MHz, channel 234A.

The Department of Industry has advised the Commission that this application is conditionally technically acceptable. The Department will only issue a Broadcasting Certificate once it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

In accordance with section 22(1) of the Broadcasting Act, the Commission will only issue the licence and grant the authority to operate when it receives notification from the Department of Industry that its technical requirements have been met, and that a Broadcasting Certificate will be issued.

11.

The Commission acknowledges and has considered the intervention submitted in support of this application.
