Acquisition of assets

1.

The Commission approves the application for authority to acquire the assets of the cable distribution undertaking serving Baie-des-Rochers, from the Coopérative de câblodistribution de Baie-des-Rochers (the Coopérative), and for a broadcasting licence to continue the operation of this undertaking.

2.

The Commission will issue a Class 3 licence to Corporation des Loisirs de Baie-des-Rochers, operating as Société de divertissement et de développement de Baie-des-Rochers, expiring 31 August 2007, upon surrender of the current licence. The operation of this undertaking will be regulated pursuant to the Broadcasting Distribution Regulations. The licence will be subject to the conditions specified in this decision and to any other condition that may be specified in the licence to be issued.

3.

The Commission notes that the licence of this undertaking will be held by a not-for-profit organization whose structure provides for membership and management by members of the community at large. All of the assets of the Cooperative will pass to the applicant.

The signals that the licensee is authorized to distribute may be received by direct reception, or from any Canadian broadcasting distribution undertaking (licensed or exempted) which is authorized to provide signals to other distributors.

5.

It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary code regarding violence in television programming, as amended from time to time and approved by the Commission.

6.

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources (PN 1992-59).
