Acquisition of cable distribution undertaking assets

1.

The Commission approves the applications that will allow Câble-Axion Québec inc. to acquire, from Gestion L.S. Tardif inc., the assets of the cable systems serving Biencourt, Lac-des-Aigles, Saint-Cyprien, Saint-Léon-le-Grand and Squatec. The Commission will issue broadcasting licences to Câble-Axion Québec inc. authorizing the operation of these undertakings. The licences will be subject to the terms and conditions set out in the appendix to this decision and to any other condition that may be specified in the licences to be issued.

The purchase price relating to these transactions is $800,000. Based on the evidence filed with the applications, the Commission has no concerns with respect to the availability or the adequacy of the required financing.

Appendix to Decision CRTC 2000-424


 

Terms and conditions of licence for the cable distribution undertakings serving Biencourt; Lac-des-Aigles; Saint-Cyprien; Saint-Léon-le-Grand; and Squatec

 

Terms

 

The operation of these undertakings will be regulated pursuant to the Broadcasting Distribution Regulations (the regulations).

 

Upon surrender of the current licences, the Commission will issue Class 3 licences to Câble-Axion Québec inc.

 

The licences will expire on the current licence expiry dates:

 

· 31 August 2003 for the undertakings serving Biencourt, Lac-des-Aigles, Saint-Léon-le-Grand and Squatec; and

 

· 31 August 2001 for the undertaking serving Saint-Cyprien.

 

The signals that the licensee is authorized to distribute may be received by direct reception, or from any Canadian broadcasting distribution undertaking (licensed or exempted) which is authorized to provide signals to other distributors.

 

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources
(Public Notice CRTC 1992-59).

 

Conditions of licence

 

The licences will be subject to the conditions specified below and to any other condition that may be specified in each licence to be issued.

 

All undertakings

 

For community programming and any other programming of a service that it originates, the licensee must adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary code regarding violence in television programming, as amended from time to time and approved by the Commission.

 

Biencourt; Lac-des-Aigles; Squatec

 

The licensee is relieved of the requirement of section 32 of the regulations to distribute the priority regional programming service of CIVB-TV (STQ) Rimouski. The licensee will distribute instead CIVM-TV (STQ) Montréal, received via satellite, on the basic band.

 

Saint-Cyprien

 

The licensee is relieved of the requirement of section 32 of the regulations to distribute the priority regional programming service of CFTF-TV (TQS) Rivière-du-Loup. The licensee will distribute instead CFJP-TV (TQS) Montréal, received via satellite, on the basic band.

 

Saint-Léon-le-Grand

 

The licensee is relieved of the requirement of section 32 of the regulations to distribute the local programming services of CBGAT-1 (SRC) Mont-Climont, CBGAT-19 (SRC) Lac Humqui as well as CFER-TV (TVA) and CIVB-TV (STQ) Rimouski. The licensee will distribute instead the regional services of CJBR-TV (SRC) Rimouski, CHAU-TV-1 (TVA) Sainte-Marguerite-Marie and CIVM-TV (STQ) Montréal, received via satellite.
