Relief from the requirement to distribute CKNX-TV

The Commission approves the applications by Rogers Cable Inc. (formerly Rogers Cablesystems Limited) and Rogers Cablesystems Ontario Limited (Rogers) for conditions of licence allowing Rogers to delete CKNX-TV Wingham from the cable systems serving the communities noted above.

The Rogers' systems are currently required, under section 17 of the Broadcasting Distribution Regulations (the regulations) to carry CKNX-TV Wingham, as well as CFPL-TV London, both of which are independent stations owned by CHUM Limited (CHUM). The London station is a local station for the Kitchener/Grand River system and an extra-regional station for the Guelph system. The Wingham station is regional with respect to the Kitchener/Grand River system and extra-regional for the Guelph system.

In support of its applications, Rogers argued that CKNX-TV Wingham and CFPL-TV London offer virtually identical programming, with the exception of local news. Rogers stated that its goal in dropping the Wingham station was not to question the value of the local programming provided by CKNX-TV, but to maximize the value of the service it offers to its customers, in light of its limited analog channel capacity.

An intervention in opposition to these applications was submitted by CHUM, which argued that Rogers had failed to provide a compelling public interest rationale for the removal of CKNX-TV. CHUM stated that at least 15% of the programming on CKNX-TV was different from that offered on CFPL-TV, and that the agricultural information provided by CKNX-TV is of significant interest to the citizens of this area of Ontario.

In response, Rogers noted that agricultural programs are offered on both CFPL-TV and CKNX-TV, and reiterated that the most compelling reason for its application is to increase the attractiveness of its available channels.

In approving these applications, the Commission expects the channels made available by this approval to be used for the distribution of Canadian television services. Further, it expects the licensee to report on this matter, within three months of the date of this decision.
