Application for costs by Action Réseau Consommateur.
Positions of parties

1.

By letter dated 5 May 2000, Action Réseau Consommateur (ARC) applied for an award of costs regarding its intervention in the above-noted proceeding.

2.

ARC submitted that it represents consumers interested in the issues reviewed in the proceeding, that it participated in a serious manner and that it contributed to a better understanding of the questions at issue by having commented on Télébec ltée's application.

3.

Since the amount of costs claimed in this case is very low, ARC requested that the costs be fixed in the adjudication process, thus avoiding the additional procedure of taxation.

By letter dated 15 May 2000, Télébec stated that it had no comments in response to ARC's request.

Commission determination

The Commission considers that ARC's participation in this proceeding satisfies the requirements of section 44 of the CRTC Telecommunications Rules of Procedure. ARC, which represents consumers, participated in a responsible manner and contributed to a better understanding of the issues in the proceeding.

Given the small size of ARC's claim and the relative brevity of this proceeding, the Commission considers that this is an appropriate case to dispense with taxation and fix the costs.

7.

The Commission has examined the amounts claimed by ARC and considers them to be reasonable and necessarily incurred.

8.

The application for an award of costs of the above-mentioned proceeding is approved. Pursuant to subsection 56(1) of the Telecommunications Act, the Commission fixes the costs to be paid to ARC at $800.

9.

Télébec shall pay forthwith the costs awarded herein.
