  Public Notice CRTC 1998-37
  In Public Notice CRTC 1996-120, "Introductory Statement - Licensing of New Specialty and Pay Television Undertakings", the Commission adopted a licensing framework for English-language specialty programming undertakings where only one service per genre would be licensed. Accordingly, it chose four English-language services to which the Access Rules would have immediate application. In addition to this core group of four services, 13 other English-language specialty programming undertakings were licensed to which the Access Rules would apply by the earlier of: the deployment of digital technology by the distributor, or 1 September 1999.
  The Commission has now received the following applications from 4 of the 13 English-language specialty programming undertakings:
  1.  ACROSS CANADA
  Application (199800678) by CANADIAN LEARNING TELEVISION LIMITED, licensee of a national English-language specialty programming undertaking, to amend condition of licence 6 to read:
  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1998.
  instead of
  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1999.
  The licensee requests the amendment in order to advance the date of right of access to carriage by a broadcasting distribution undertaking.

  2.  ACROSS CANADA
  Application (199800686) by CHUM LIMITED (MUCHMOREMUSIC), licensee of a national English-language specialty programming undertaking, to amend condition of licence 8 to read:
  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1998.
  instead of
  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1999.

  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1998.
  instead of
  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1999.

  Application (199713532) by THE PARTNERS OF THE "REPORT ON BUSINESS TELEVISION" (ROBTv), licensee of a national English-language specialty programming undertaking, to delete condition of licence 6 which reads:
  The licensee may require access to distribution undertakings in accordance with the Access Rules contained in Public Notice CRTC 1996-60 at the earliest of the following:
  a) at such time as the distribution undertaking makes use of digital technology for the delivery of programming to subscribers; or
  b) 1 September 1999.
  The licensee requests the deletion of this condition of licence in order to obtain immediate access to carriage by a broadcasting distribution undertaking.

  Intervention

  ·  submit your original written intervention to the Secretary General of the Commission (CRTC, Ottawa, K1A 0N2). A true copy MUST be sent to the applicant and a proof of such sending must accompany the original sent to the Commission;
  ·  the intervention must be received by the CRTC and by the applicant ON OR BEFORE the deadline date indicated below. The Commission cannot be held responsible for postal delays;
  ·  your intervention should clearly identify the application and indicate whether you support or oppose the application, or if you propose changes to it, with facts and grounds therefor. In the event that the application is brought to the oral phase of a hearing it would be helpful to the Commission if you provide reasons why your written comments are not sufficient and an appearance is necessary;
  Your intervention will be considered by the Commission, and will form part of the public record of the proceeding without further notification to you, provided the procedure set out above has been followed. You will be contacted only if your submission raises procedural questions.
