Transfer of control and shares
1. The Commission announces that it has approved, by Letter of Authority A98-0144 dated 18 November 1998, a change to the effective control of Nornet Broadcasting Limited, licensee of the radio programming undertakings CFNL and CKRX-FM Fort Nelson, CKNL and CHRX-FM Fort St. John and CJEV Elkford, British Columbia, and CKBA Athabasca, CJPR Blairmore, CIBQ Brooks, CKDQ Drumheller, CJCM Grand Centre, CKVH High Prairie, CHLW St. Paul, CKSQ Stettler, CKKY Wainwright, CFOK Westlock, CKJR Wetaskiwin and CKWA Slave Lake, Alberta, through the transfer of all of the issued and outstanding shares held by Len Novak, Norscot Holdings Ltd. and 548705 B.C. Ltd. to Okanagan Skeena Group Limited, on behalf of a company to be incorporated. This company is controlled by Okanagan Skeena Group Limited, a Canadian controlled company.
2. Consistent with the requirements of the Benefits Test outlined in Public Notice CRTC 1998-41 entitled Commercial Radio Policy 1998, the benefits offered represent the required minimum direct financial contribution to Canadian talent development of 6% ($573,730) of the value of the transaction. The Commission approves the benefits (over 7 years) as being 3% ($286,860) to be allocated to the Canadian Music Marketing and Promotion Fund, which is to be created, 2% ($191,240) as a FACTOR contribution, and 1% ($95,630) to local talent development initiatives involving The Fernie Music Festival and a regional Star Search. The 3% contribution which is to be allocated to the Canadian Music Marketing and Promotion Fund must be directed to the Canadian Association of Broadcasters who will hold all contributions in trust pending the creation of this fund. It is understood that these commitments are over and above the existing commitments and conditions of licence of each of the stations involved.
