Telecom Order CRTC 98-386
On 24 November 1997, the Commission received an application from Westel Telecommunications Ltd. (Westel) for approval of two agreements between Westel and GST Telecom, Inc. (GST).

1. Westel stated in its application that the two agreements concern the interconnection of the frame relay networks of Westel and GST and the extension of each company's frame relay services to each other's customers.
2. The Commission notes that the agreements do not contain the bypass prohibition approved in Telecom Order CRTC 90-252, 22 March 1990 (Order 90-252) and in Telecom Order CRTC 94-734, 28 June 1994 (Order 94-734).
3. The Commission also notes that the issue of the bypass of traffic through the U.S. has been raised in the proceeding initiated by Competition in the Provision of International Telecommunications Services, Telecom Public Notice CRTC 97-34, 2 October 1997.
4. Pending possible changes resulting from that proceeding, the Commission considers it appropriate that the agreements between Westel and GST be amended to include a provision consistent with the language approved in Orders 90-252 and 94-734.
5. In light of the above, the agreements are approved, subject to the inclusion of language with regard to the bypass of traffic through the U.S. similar to that approved in Orders 90-252 and 94-734.
