Licence renewal for CKAJ-FM
1. Following Public Notice CRTC 1998-51 dated 19 May 1998, the Commission renews the licence for Type B community radio programming undertaking CKAJ-FM Jonquière, from 1 September 1998 to 31 August 2005, subject to conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
2. The Commission notes the exemplary involvement of a number of public organizations in the relaunching of the station (formerly CHOC-FM). The Commission wishes to emphasize that the licensee must direct its operations effectively in order to facilitate the day-to-day management of this community-oriented station.
3. In addition, the Commission notes the licensee's sincere efforts over the last short-term licence renewal to ensure compliance with the Radio Regulations, 1986 (the regulations) and with its conditions of licence at all times. It will nevertheless continue to monitor closely the licensee's performance and expects the licensee, over the new licence term, to comply at all times with the regulations and its conditions of licence.
4. It is a condition of licence that the licensee devote a minimum of 5% of overall musical programming to category 3 material.
5. It is a condition of licence that the licensee broadcast no more than 6 minutes of advertising in any hour of broadcast, and that it broadcast no more than an average of 4 minutes of advertising for every hour of broadcast up to a total of 504 minutes of advertising per week, in accordance with the community radio policy for Type B stations.
6. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It considers that community radio stations should be particularly sensitive to this issue in order to reflect fully the communities they serve. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
7. In accordance with subsection 22(1) of the Broadcasting Act (the Act), this renewal is subject to the issuance of a Broadcasting Certificate by the Department of Industry.
8. The Commission draws the licensee's attention to subsection 22(4) of the Act which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 of the Act is of no force or effect.
9. The Commission acknowledges the intervention submitted by the Association des radiodiffuseurs communautaires du Québec in support of this application.
