Licence amendments

1.  Following Public Notice CRTC 1997-141 dated 2 December 1997, the Commission announced an application by Western Co-Axial Limited (Western) to amend the broadcasting licence for the Class 2 cable distribution undertaking serving the above noted communities by, among other things, deleting the local head end of the undertaking and interconnecting it, via optical fibre, to the Class 1 cable distribution undertaking serving part of Hamilton, part of Ancaster, Dundas and surrounding area and part of Flamborough, also owned by the licensee.

2.  The Commission notes that, in Public Notice CRTC 1997-25 dated 11 March 1997, it confirmed its intention to eliminate the requirement that cable licensees own, among other things, their local head end. The Broadcasting Distribution Regulations (the regulations) which came into effect on 1 January 1998 do not impose this requirement. Therefore, approval of that part of the application is no longer required.

3.  Finally, noting that the source undertaking serving part of Hamilton, part of Ancaster, Dundas and surrounding area and part of Flamborough distributes the following signal, Western is authorized to distribute the duplicate network service of WNEQ-TV (PBS) Buffalo, New York, as part of the basic service.

4.  The licensee is authorized to receive this signal over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings. The Commission notes that Western plans to receive WNEQ-TV by optical fibre.

5.  The Commission approves the licensee's application to amend the licence of the undertaking by adding a condition of licence, as provided for in section 25 of the regulations, to allow the distribution of CBLT Toronto on a restricted channel.

6.  The Commission also approves the licensee's application to amend the licence of the undertaking, by adding a condition of licence relieving the licensee of the requirement of section 17 of the regulationsto distribute the programming service of priority regional station CKNX-TV (IND) Wingham. The licensee will instead distribute CFPL-TV London.

7.  Further, the Commission approves the licensee's request to delete the condition of licence authorizing the distribution, at the licensee's option, of WXYZ-TV (ABC) and WDIV (NBC) Detroit, Michigan, received via satellite from Cancom, as part of the basic service. The Commission notes that Western is currently not distributing these programming services.

This decision is to be appended to the licence.
