NOTICE OF CHANGE
RELATING TO A
PUBLIC NOTICE
Further to its Public Notice CRTC 1997-22 dated 28 February 1997, the Commission announces the following:
AT THE REQUEST OF THE APPLICANT, THE FOLLOWING ITEM IS WITHDRAWN FROM THE PUBLIC NOTICE
Item 1
 KAKABEKA FALLS, Ontario
Application (199617883) by FIBER-TEL ENTERPRISES INC., to amend the broadcasting licence of the Multipoint Distribution System (MDS) undertaking serving Kakabeka Falls and surrounding areas, by deleting the following condition of licence in response to Public Notice CRTC 1995-183 dated 26 October 1995 "Removal of restrictions concerning the solicitation or acceptance of subscriptions by the licensees of radiocommunication undertakings within the authorized service areas of other subscription-based distribution undertakings":
 It is a condition of licence that the licensee shall not solicit or accept a subscription from, or make available equipment to decode its signals for use by, any person resident inside or outside of the area encompassed by the contours approved by the Commission, when that person is resident
·  within the authorized service area of any (cable) distribution undertaking licensed now or in the future; or
·  within the area encompassed by the contours approved by the Commission for any other subscription-based broadcasting undertaking licensed now or in the future
 unless the prior written consent of the applicant or licensee of the other undertaking or the prior approval of the Commission has been obtained or, in the case of a person residing inside the approved contours, that person had subscribed to the licensee's subscription television service prior to the licensing of the other undertaking.
