Telecom Order CRTC 97-77
IN THE MATTER OF an application by BC TEL under Tariff Notice 3504 (TN 3504) dated 1 August 1996, proposing revisions to the company's Cellular Access tariff for the provision of trunk-side access and Common Channel Signalling #7 (CCS7) to Cellular Service Operators and extending the tariff to Personal Communications Service (PCS) carriers and Specialized Mobile Radio/ Enhanced Specialized Mobile Radio (SMR/ESMR) Service Operators.
WHEREAS the Commission granted TN 3504 interim approval in Telecom Order CRTC 96-969 dated 30 August 1996;
WHEREAS BC TEL stated that its application was consistent with the directives set out in Telecom Order CRTC 96-687 (Order 96-687) dated 28 June 1996;
WHEREAS Order 96-687 established an interim regime for the interconnection of the public mobile radio service of a Wireless Service Operator (WSO) with Bell Canada's public switched telephone network pending resolution of matters under consideration in Implementation of Regulatory Framework - Local Interconnection and Network Component Unbundling Telecom Public Notice CRTC 95-36, 11 July 1995, (PN 95-36);
WHEREAS Order 96-687 provided for tandeming and transiting on a trunk-side connection basis;
WHEREAS comments were received from Clearnet Communications Inc. (Clearnet), Microcell Telecommunications Inc. (Microcell) and Rogers Cantel Inc. (Cantel);
WHEREAS BC TEL filed reply comments;
WHEREAS Microcell stated that its application to review and vary Order 96-687 also represents its comments on BC TEL TN 3504;
WHEREAS Cantel requested that BC TEL be directed to provide tandem and transiting functionality from the switches currently serving Cantel;
WHEREAS BC TEL replied that WSO originated local calls destined for BC TEL's local network must be routed as BC TEL currently routes its own traffic;
WHEREAS BC TEL noted that in the BC Lower Mainland free calling area its network incorporates two local tandem switches and that a WSO would need to connect to each of them to gain access to the total local calling area;
WHEREAS the Commission notes that with line-side interconnection, only one point of connection is required to gain access to the total local calling area;
WHEREAS Cantel proposed that BC TEL be directed to continue to perform telephone number administration;
WHEREAS the Commission notes that the proposed revisions do not change BC TEL's current telephone number administration responsibilities;
WHEREAS Cantel and Clearnet questioned the application of a link charge for trunk-side interconnection;
WHEREAS BC TEL replied that in providing trunk-side access there remains a requirement for the termination of an access channel on the company's switch, and that the proposed wireless link tariff element provides that functionality;
WHEREAS Cantel and Clearnet submitted that the proposed toll traffic termination tariff element should be eliminated;
WHEREAS BC TEL responded that the toll traffic termination tariff element was the only way that it could terminate toll traffic to a WSO's switch on a trunk-side basis; and
WHEREAS the Commission notes that line-side connections remain available to WSOs for originating and terminating toll traffic and considers that the toll traffic termination tariff element is an option for those WSOs who wish to avail themselves of CCS7 features for incoming toll traffic -
IT IS HEREBY ORDERED THAT:
1. BC TEL is to file proposed tariff pages for interim approval within 30 days that allow for local tandem trunk-side connection as well as transiting of traffic, such that one point of connection will allow for connection to the total local calling area. The associated rate element is to allow for the recovery of any one-time incremental cost, such as software and associated processor costs, to convert the switch to the tandem functionality.
2. The existing Cellular Access Service tariff is hereby made interim, effective the date of this Order, pending the resolution of matters under consideration in PN 95-36.
