Telecom Order CRTC 97-1928
On 30 September 1997, Télébec ltée (Télébec) filed Tariff Notice (TN) 159 providing for tariff revisions pursuant to the Commission's letter of 13 August 1997, pertaining to the following bill management tools: calling cards, toll restriction, applicable late payment charge and a six month instalment payment plan for connection charges. On 6 October 1997, the company filed TN 159A seeking to delay the date of implementation of the modifications proposed in TN 159.

1. By letter dated 13 August 1997 (the 13 August letter), the Commission directed Télébec to adopt the late payment charge formula approved for Bell Canada (Bell) and BC TEL. The Commission also directed Télébec to calculate the interest owed on the unpaid balance of the instalment payment plan based on that formula.
2. Télébec proposes to restrict the application of the formula approved for Bell and BC TEL to the instalment payment plan to be offered to residence customers.
3. The Commission considers that Télébec's position regarding the adoption of the late payment charge is inconsistent with the decision outlined in the 13 August letter. Accordingly, the Commission finds that Télébec's tariff regarding late payment charges should be modified to reflect that decision.
4. The Commission also notes that the late payment charge tariff should indicate the interest rate payable in addition to the formula on which it is based.
5. In light of the foregoing, the Commission orders that:
(a) Télébec adopt the late payment charge formula approved for Bell and BC TEL.
(b) The proposed tariff revisions are approved subject to the following revisions to Télébec's General Tariff being implemented:
(i) Item 1.3.2.3 is to be modified to show the rate that will be applicable and to indicate that this rate was developed in accordance with the formula approved by the Commission on 23 January 1983 and is based on the prime rate of the Banque Nationale plus 7%; and
(ii) Item 4.2.2.3 is to be modified to indicate that the compound rate specified in Item 1.3.2.3 is applied to the unpaid balance.
(c) Télébec issue revised tariff pages within 10 days of the date of issuance of this Order.
