New cable distribution undertaking
Following a Public Hearing in Montréal beginning on 2 December 1996, the Commission approves the application by Câblevision HSL-SDM inc., for a licence to carry on a cable distribution undertaking to serve Athelstan. The operation of this undertaking will be regulated pursuant to Parts I, III and IV of the Cable Television Regulations, 1986 (the regulations).
Subject to the requirements of this decision, the Commission will issue a licence expiring 31 August 1999. This licence will be subject to the conditions specified in this decision and in the licence to be issued. This term is consistent with the Commission's practice regarding the licensing of new Part III cable distribution undertakings.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute CIVM-TV (STQ) and CFJP-TV (TQS) Montréal, received via microwave, as part of the basic service.
Although the Commission does not regulate the rates of Part III cable distribution undertakings, it notes that the applicant has proposed a monthly subscriber fee of $25.51.
The Commission approves the appli-cant's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the applicant be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those U.S. television services listed in the current application or as may be authorized by the Commission.
In approving this request, the Commission has taken into consideration the fact that WCAX-TV (CBS) and WVNY-TV (ABC) Burlington, Vermont, and WPTZ-TV (NBC) Plattsburgh, New York, are receivable over the air at the local head end.
This authority will only be effective and the licence will only be issued at such time as the construction of the undertaking is completed and it is prepared to commence operation. If the construction is not completed within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete construction and commence operation before the expiry of this period and that an extension of time is in the public interest, within such further periods of time as are approved in writing by the Commission, the licence will not be issued. The applicant is required to advise the Commission (before the expiry of the twelve-month period or any extension thereof) in writing, once it has completed construction and is prepared to commence operation.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Imple-mentation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the applicant to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
This decision is to be appended to the licence.
