Licence renewal
1. Following Public Notice CRTC 1997-56 dated 13 June 1997, the Commission renews the Class 1 licence held by Lindsay CATV System Limited, for the cable distribution undertaking serving Lindsay, from 1 September 1997 to 31 August 2004.
2. The operation of this undertaking is regulated pursuant to Parts I, II and IV of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
3. Consistent with Decision CRTC 91-769 dated 25 September 1991, the licensee is relieved, by condition of licence, from the requirement of section 12 of the regulations to distribute the programs of CHEX-TV Peterborough on an unrestricted channel. Should the quality of the signal deteriorate significantly, the licensee will be expected to undertake immediate corrective action such as moving the service to another channel.
4. Also consistent with Decision CRTC 91-769, the licensee is relieved, by condition of licence, from the requirement of paragraph 9(1)(c) of the regulations to distribute local signals CICO-TV-74 (TVO) and CIII-TV-27 (IND) Peterborough, received over the air. The licensee is authorized to distribute instead the extra-regional signal of CICA-TV (TVO) received via satellite and the regional signal of CIII-TV-41 (IND) Toronto, received over the air.
5. Consistent with Decision CRTC 95-153 dated 13 April 1995, the licensee is relieved, by condition of licence, of the requirement of paragraph 16(2)(a) of the regulations to distribute the priority audio programming service CKPT Peterborough.
6. Consistent with Decision CRTC 95-920 dated 21 December 1995, the licensee is authorized to originate a video games service as a special programming service, offered on a discretionary basis, subject to the conditions listed in that decision.
7. Consistent with Decision CRTC 95-922 dated 21 December 1995, the licensee is authorized, by condition of licence, to insert, at its option, certain promotional material as a substitute for the "local availabilities" (i.e. non-Canadian advertising material) of non-Canadian satellite services. At least 75% of these local availabilities must be made available for use by licensed Canadian programming services for the promotion of their respective services, for the promotion of the community channel and for unpaid Canadian public service announcements. A maximum of 25% of the local availabilities may be made available for the promotion of discretionary programming services and packages, customer service information, channel realignments, cable FM service and additional cable outlets.
8. The Commission has noted the licensee's efforts in the development of community programming that reflects the interests and concerns of the communities that it serves. In Public Notice CRTC 1997-25 entitled New Regulatory Framework for Broadcasting Distribution Undertakings, the Commission adopted a more flexible approach towards a requirement to provide local expression. The Commission remains convinced that community channels will continue to provide a vibrant, local service, particularly where there is public demand for the service.
9. It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary Code Regarding Violence in Television Programming, as amended from time to time and approved by the Commission.
10. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
