Licence amendment
Following Public Notice CRTC 1997-4 dated 10 January 1997, the Commission approves the application to amend the licence for the (MDS) radiocommunication distribution undertaking serving the above-noted communities as follows:
-  by deleting the distribution of WCAX-TV (CBS) Burlington, Vermont, WPTZ-TV (NBC) Plattsburgh, New York, WTBS (IND) Atlanta, Georgia, The Movie Network (First Choice) and by adding the signals of the Réseau de l'information (RDI), Le Canal D, Le Canal Famille, The Sports Network (TSN) and The Arts and Entertainment Network (A&E); the Commission notes that the licensee proposes to share the channel of the Electronic Bulletin Board with the Canal Famille service which ceases all programming at 7:00 p.m. each day;
-  by relieving the licensee of the requirement to distribute the extra-regional station CFTU-TV (IND) Montréal, received off air; the Department of Industry having confirmed the poor reception quality of the signal at the undertaking;
-  by increasing the effective isotropic radiated power (EIRP) from 48.8 watts to 71.6 watts; this amendment will change the coverage area of the undertaking by extending it to the northeast for a distance of approximately 12 kilometres.
The approval granted herein reflects the technical parameters of the undertaking as built, and not those originally authorized.
The Commission also approves the licensee's request to delete the condition of licence prohibiting it from soliciting or accepting a subscription from, or making available decoding equipment for use by, any person resident within the authorized service area of any cable distribution undertaking, or within the approved service contours of any other subscription-based broadcasting undertaking.
The Commission received two opposing interventions from Emtel inc. (Emtel), licensee of the cable distribution undertaking authorized to serve Saint-Anicet, Sainte-Barbe and Saint-Stanislas-de-Kostka and from C.E.F. Ganesh Corporation, a firm of consultants. Both interveners expressed concerns as to the impact that the proposed amendments would have on Emtel's cable undertaking and on any future regional MDS undertaking. The Commission is satisfied with the licensee's reply to the interventions wherein it is pointed out that, as noted above, the proposed amendment to the undertaking's coverage area will reflect the actual coverage of the antennas and that the MDS signal will not affect Emtel's undertaking as it (TRANSLATION( "has no line of sight towards this area".
This decision is to be appended to the licence.
