STENTOR - FORBEARANCE APPLICATION FOR ELECTRONIC MESSAGING AND INFORMATION SERVICES
I BACKGROUND
On 4 April 1996, Stentor Resource Centre Inc. (Stentor), on behalf of AGT Limited, BC TEL, Bell Canada, The Island Telephone Company Limited, MTS NetCom Inc., Maritime Tel & Tel Limited, The New Brunswick Telephone Company, Limited and NewTel Communications Inc. (collectively, the companies), filed an application pursuant to section 34 of the Telecommunications Act (the Act) requesting that the Commission forbear from the regulation of the companies’ electronic messaging and information services. Stentor stated that these services encompass the companies’ Intelligent Communication Network portfolio of services which include Envoy 100, TradeRoute, ICN Enhanced Fax, iNet as well as customized applications of these services provided on a Special Facilities Tariff basis. Stentor also stated that its forbearance application encompasses any similar services that the companies may offer in the future that fall within this same class of electronic messaging and information services.
Stentor requested that the Commission refrain from exercising all powers and performing all duties under all of the sections noted in section 34 of the Act. The Commission seeks comment regarding the appropriateness of forbearing pursuant to section 34 of the Act. The Commission notes that, in Review of Regulatory Framework, Telecom Decision CRTC 94-19, 16 September 1994, it detailed the factors that it will consider when assessing whether a particular market is sufficiently competitive for the Commission to refrain from regulation. Parties are expected to address these factors in their submissions.

3. Parties wishing to comment with regard to Stentor’s application (interveners) may do so by writing Mr. Allan J. Darling, Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, fax: (819) 953-0795 by 30 June 1996. A copy is to be served on Stentor at the address noted above by the same date.
4. Stentor may file a reply to any comments, serving copies on interveners by 28 June 1996.
5.
