Proposed Amendments to the Pay Television Regulations, 1990
Definition of "commercial message"
Attached to this notice is a copy of proposed amendments to the Pay Television Regulations, 1990 (the regulations). The definition of "commercial message" in subsection 2(1) of the existing regulations excludes public service announcements, an advertisement for a program distributed by a licensee, and the identification of a pay television network or production credits. The proposed amendments would also exclude from the definition of "commercial message" an advertisement contained in the live feed of sports programming acquired by a licensee and originating in a stadium, arena or other venue from which the event is broadcast, where the licensee has not accepted any compensation for the advertisement.
At the same time, the expression "pay television network" contained in the definition of "commercial message" would be changed to "pay television programming undertaking" in order to reflect the terminology used in the Broadcasting Act.
Parties wishing to comment on any of the proposed amendments must send their submissions to the Secretary General, CRTC, Ottawa, (Ontario), K1A 0N2, by Monday, 7 October 1996. While receipt of submissions will not be acknowledged, they will be considered by the Commission and will form part of the proceeding.
