Decision

Ottawa, 16 October 1996
Decision CRTC 96-678
Canadian Satellite Communications Inc. (Cancom)
Across Canada - 952604700
Addition of KCPQ (FOX)
Following Public Notice CRTC 1996-100 dated 12 July 1996, the Commission approves the application to amend the broadcasting licence to carry on a multiple-channel television and radio broadcasting relay distribution undertaking by adding KCPQ (FOX) Seattle, Washington to the list of signals that Cancom is authorized to distribute.
In Public Notice CRTC 1996-137 of today's date entitled "Revised Lists of Eligible Satellite Services", the Commission has amended the list of Part II Eligible Satellite Services and the list of Part III Eligible Canadian Satellite Services accordingly.
In Decision CRTC 94-702 dated 29 August 1994, Cancom was authorized to include the signal of WUHF-TV (FOX) Rochester, New York to the list of signals that it is authorized to distribute. In the application for KCPQ, Cancom indicated that this signal, which originates from the Pacific time zone, will appeal to licensees of cable distribution undertakings in Western Canada.
The Commission reminds licensees of cable distribution undertakings that they may not distribute a duplicate signal of a commercial U.S. network, received from Cancom, unless otherwise authorized pursuant to a condition of licence.
The Commission also reminds licensees holding Class 1 licences, or Class 2 licences for undertakings that have between 2,000 and 6,000 subscribers, that prior Commission approval is required to add this U.S. signal or substitute it for another FOX signal, as part of the basic service of their undertakings.
The Commission acknowledges an intervention in support of this application.
This decision is to be appended to the licence.
Allan J. Darling
Secretary General
