Licence amendments
Following Public Notice CRTC 1995-83 dated 23 May 1995, the Commission approves the application to amend the licence for the cable distribution undertaking serving Squatec, by adding a condition of licence relieving the licensee of the requirement of paragraph 22(1)(b) of the Cable Television Regulations, 1986 (the regulations) to distribute the priority regional programming service of CIVB-TV (SRTQ) Rimouski. The licensee will distribute instead CIVM-TV (SRTQ) Montréal, received via satellite, on the basic band.
In addition, the Commission notes that the licensee has requested an exemption from the requirement of section 23 of the regulations, stating that distribution of additional English-language services from CANCOM was not warranted in view of the exclusively francophone population it is authorized to serve. The Commission notes, however, that the licensee proposes to add the distribution of the programming service of New Country Network (NCN), an English-language specialty service.
The Commission has considered the licensee's request and, in view of the above, has determined that an exemption from section 23 would not be warranted should the licensee add the distribution of NCN.
Therefore, the Commission approves the licensee's request with respect to section 23 of the regulations so long as it deletes NCN from its distribution list. Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those English-language television services which are currently offered.
Accordingly, the Commission expects the licensee to delete NCN from its distribution list and replace it with a French-language service, or to comply with the four-signal requirement of section 23 of the regulations. The licensee is required to file, within three months of the date of this decision, a report confirming which of these two options it has chosen.
The Commission has noted the concerns expressed by CANCOM in an opposing intervention to this application.
