Licence renewal
Following Public Notice CRTC 1994-146 dated 2 December 1994, the Commission renews the Class 1 licence held by Valleyfield Transvision Inc., for the cable distribution undertaking serving Valleyfield, from 1 September 1995 to 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act (the Act), will enable the Commission to consider the next licence renewal of this undertaking in accordance with the Commission's regional plan and to better distribute the workload within the Commission. This term is not reflective of any Commission concern regarding the licensee's performance.
The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
The Commission approves the licensee's request with respect to the distribution of CFMT-TV-1 (IND) Ottawa. Accordingly, the licensee is relieved, by condition of licence, from the requirement of subsection 9(1) of the regulations to distribute CFMT-TV-1. The Commission notes that the Department of Industry has confirmed that this signal is not received at the undertaking's head end.
The licensee also requested to be relieved from the requirement to distribute CHLF-TV-2 (La Chaîne) and CICA-TV-96 (TVO) Hawkesbury, Ontario. In this respect, the Commission notes that, pursuant to subsection 9(3) of the regulations, the licensee is not required to distribute the programming service of an out-of-province educational broadcaster.
Consistent with Decision CRTC 90-111, the licensee is authorized to continue to distribute, at its option, WETK (PBS) Burlington, Vermont and WCFE-TV (PBS) Plattsburgh, New York, received via microwave, as part of the basic service.
Consistent with the above-mentioned decision, the licensee is relieved, by condition of licence, of the requirement of section 12 of the regulations that it distribute the programs of CBFT (CBC), CBMT (CBC), CFTM-TV (TVA) and CFCF-TV (CTV) Montréal and CJOH-TV-8 (CTV) Cornwall on unrestricted channels. Should the quality of the signals deteriorate significantly, the licensee will be expected to undertake immediate corrective action such as moving these services to other channels.
The Commission approves, by condition of licence, the request to be relieved from the requirement to distribute, in accordance with subsection 16(2) of the regulations, local service CKIS Montréal, as the Department of Industry has confirmed that the licensee cannot receive this signal.
The Commission denies the licensee's request to be relieved from the requirement of subsection 16(2) of the regulations to distribute the radio service CISM-FM Montréal as the Department of Industry has confirmed that the quality of reception of this signal is good. In this regard, the Commission acknowledges the opposing intervention submitted by CISM-FM as well as the licensee's reply wherein it indicates that it is prepared to distribute CISM-FM.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the licensee's expenses in the last year and of the annual budgets which will be allocated for community programming during the new licence term. The Commission commends the licensee for its efforts and encourages it to continue to develop community programs that reflect subscriber interests and concerns.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
