Acquisition of assets
Following a Public Hearing in the National Capital Region on 30 November 1994, the Commission approves the application for authority to acquire the assets of the cable distribution undertaking serving Tofino from Tofino Television Association, and for a broadcasting licence to continue the operation of this undertaking.
The Commission will issue a licence to Glenn Johnson, on behalf of a company to be incorporated, expiring 31 August 2000, the current expiry date, upon surrender of the current licence. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986. The authority granted herein is subject to the same conditions as those in effect under the current licence, as well as to any other condition specified in the licence to be issued.
This authority will only be effective and the licence will only be issued when the Commission receives documentation establishing that an eligible Canadian corporation has been incorporated and that it may be issued a licence.
The price of the transaction is $16,500. Based on the evidence filed with the application, the Commission has no concerns with respect to the availability or the adequacy of the required financing. The Commission notes that the intangible benefit flowing from this transaction is the continuation of service to Tofino. In view of the above, the Commission has determined that approval of this application is in the public interest.
The Commission reminds the purchaser of its longstanding policy that subscribers should not be required to pay higher fees merely because the ownership or control of a cable system has changed hands.
