Decision

Ottawa, 28 April 1995
Decision CRTC 95-188
A.J. Gale Limited
Baie Verte; Lewisporte; Springdale; Twillingate and surrounding areas, Newfoundland - 942248600- 942249400 - 950168500 - 950169300
Addition of TVOntario programming service - Denied
Following Public Notice CRTC 1995-31 dated 27 February 1995, the Commission denies the application for authority to distribute the programming service of TVOntario, received via satellite, as part of the basic service of the cable distribution undertakings serving the above-noted localities.
An intervention was received from TVOntario objecting to the applicant's proposal to distribute TVOntario programming received via satellite. The Commission draws to the applicant's attention that, pursuant to the Cable Television Regulations, 1986 and as set out in the revised list of Part III Eligible Canadian Satellite Services (Appendix to Public Notice CRTC 1995-8 dated 19 January 1995), authorization for the distribution of out-of-province educational services not receivable over the air is subject to the requirement that there be no objection on the part of the originating service. In light of TVOntario's objection, the Commission is not prepared to authorize the proposed distribution of TVOntario's programming service.
Allan J. Darling
Secretary General
