Change in music format and Canadian talent development commitments -Denied

Following Public Notice CRTC 1994-94 dated 9 August 1994, the Commission denies the application to amend the broadcasting licence for CKAT-FM North Bay, by changing the music format from Group II (Country) to Group I (Pop, Rock and Dance); and by reducing the annual amount of the direct costs budget for Canadian talent development from $9,600 to $8,000.

The Commission has taken into account the licensee's argument that the change in music format would attract listeners from the audience under 35 years of age in North Bay. The Commission is however, concerned with the documented and repeated instances of non-compliance by the licensee with respect to the requirement of the FM policy which limits the weekly level of hits to less than 50%. It notes that a 1992 short-term renewal followed non-compliance situations. Apparent non-compliance has also been documented during the current licence term. This issue will be further appraised by the Commission in the context of the renewal of the station`s licence due to expire 31 August 1995.

The Commission considers that a station's compliance with established policy requirements and regulations is fundamental when assessing the merits of any amendment request. Accordingly, the licence amendments proposed for CKAT-FM are denied.
